PickGrub, Inc. ("PickGrub," "we," "us," or "our") operates the PickGrub food discovery platform available at pickgrub.com and related mobile or web applications (collectively, the "Service"). This Privacy Policy explains how we collect, use, disclose, and protect your personal information when you use the Service, including when you interact with us via SMS/text messaging programs.

By using the Service, you agree to the collection and use of information in accordance with this policy. If you do not agree, please discontinue use of the Service.

1. Information We Collect

1.1 Information You Provide Directly

When you create an account, claim a restaurant listing, submit a pick, or contact us, we may collect your name, email address, phone number, username, profile photo, and any content you submit (reviews, picks, photos). Restaurant owners may additionally provide business name, address, hours, and payment information processed through our third-party payment processor (Stripe).

1.2 Information Collected Automatically

When you use the Service we automatically collect device identifiers, IP address, browser type and version, operating system, referring URLs, pages viewed, time spent on pages, and clickstream data. We use cookies, web beacons, and similar tracking technologies to support authentication sessions and analytics.

1.3 Information from Third Parties

If you sign in via a third-party OAuth provider (e.g., Manus), we receive basic profile data such as your name and email address as permitted by that provider. We may also receive restaurant and location data from Google Places API to supplement our listings.

2. SMS / Text Messaging Program

2.1 Program Description

PickGrub may send you text messages (SMS/MMS) for the following purposes: account verification codes, transactional alerts (e.g., listing claim confirmations, subscription receipts), and, where you have separately opted in, promotional messages about new restaurant picks, city launches, and exclusive member offers in your area.

2.2 Consent & Opt-In

We will only send marketing or promotional SMS messages to users who have affirmatively opted in by providing their mobile phone number and checking the applicable consent box during account registration, checkout, or a dedicated sign-up form. Providing your phone number for account verification purposes does not constitute consent to receive marketing messages.

By opting in to our SMS program, you consent to receive recurring automated marketing text messages from PickGrub at the mobile number you provide. Consent is not a condition of purchase or use of the Service. Message frequency varies.

2.3 Opt-Out Instructions

You may opt out of marketing SMS messages at any time by replying STOP to any message you receive from us. After opting out, you will receive a single confirmation message and no further marketing texts will be sent. To re-subscribe, reply START.

2.4 Help

2.5 Message & Data Rates

Message and data rates may apply depending on your mobile carrier plan. PickGrub is not responsible for any charges incurred from your mobile carrier. Check with your carrier for details.

2.6 Supported Carriers

Our SMS program is supported by major U.S. carriers including AT&T, T-Mobile, Verizon, Sprint, Boost Mobile, MetroPCS, U.S. Cellular, and others. Carrier support is not guaranteed for all carriers.

2.7 No Sharing of Phone Numbers

We do not sell, rent, or share your mobile phone number with third parties for their own marketing purposes. Phone numbers collected for SMS programs are used solely to deliver the messages you have consented to receive.

3. How We Use Your Information

We use the information we collect to:

  • Provide, operate, and improve the Service and its features;
  • Authenticate your identity and maintain your account;
  • Process payments and manage restaurant subscriptions;
  • Send transactional communications (receipts, verification codes, security alerts);
  • Send marketing communications where you have consented, including SMS messages described in Section 2;
  • Personalize your experience (city recommendations, pick suggestions);
  • Detect and prevent fraud, abuse, and violations of our Terms of Service;
  • Comply with applicable legal obligations; and
  • Respond to your inquiries and provide customer support.

4. Sharing of Information

We do not sell your personal information. We may share your information with:

  • Service Providers: Third-party vendors who assist us in operating the Service (e.g., Stripe for payments, cloud hosting providers, SMS delivery providers, analytics platforms). These providers are contractually obligated to protect your data and use it only as directed by us.
  • Business Transfers: In connection with a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction.
  • Legal Requirements: When required by law, subpoena, court order, or to protect the rights, property, or safety of PickGrub, our users, or the public.
  • With Your Consent: In any other circumstances where you have given us explicit consent to share your information.

5. Cookies & Tracking Technologies

We use cookies and similar technologies to maintain your login session, remember your city preference, and analyze usage patterns. You can control cookie settings through your browser; however, disabling cookies may affect the functionality of the Service. We do not currently respond to "Do Not Track" browser signals.

6. Data Retention

We retain your personal information for as long as your account is active or as needed to provide the Service. If you delete your account, we will delete or anonymize your personal data within 90 days, except where retention is required by law or legitimate business purposes (e.g., fraud prevention, financial records).

7. Data Security

We implement industry-standard technical and organizational measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. These include encrypted data transmission (TLS), hashed credentials, and access controls. No method of transmission over the internet or electronic storage is 100% secure; we cannot guarantee absolute security.

8. Children's Privacy

The Service is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If you believe we have inadvertently collected such information, please contact us immediately at [email protected] and we will promptly delete it.

9. Your Privacy Rights

Depending on your jurisdiction, you may have the right to access, correct, delete, or restrict the processing of your personal information, or to receive a portable copy of your data. California residents may have additional rights under the California Consumer Privacy Act (CCPA). To exercise any of these rights, contact us at [email protected]. We will respond within 30 days.

10. Third-Party Links

The Service may contain links to third-party websites or services (e.g., restaurant websites, Google Maps). We are not responsible for the privacy practices of those third parties and encourage you to review their privacy policies.

11. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the new policy on this page with an updated effective date and, where appropriate, by sending you an email or in-app notification. Your continued use of the Service after changes are posted constitutes your acceptance of the revised policy.
